Affidavit of Customer
- I am not an unlawful user or addicted to any controlled substance.
- By selling or delivering ammunition to me, Tombstone Tactical is not violating any state or local law or ordinance.
- I have never been and I am not expected to be convicted in any court of a misdemeanor crime of domestic violence.
- I am not under indictment for and have never been convicted in any court of a crime punishable by imprisonment for over one year.
- I am not a fugitive from justice.
- I am currently not subject to a restraining order of any kind.
- I have not been adjudicated as a mental defective and I have not been committed to any mental institution.
- I am not an illegal or unlawful alien.
- I have never been and I am not expected to be discharged from the Armed Forces under dishonorable conditions.
- I am not currently less than twenty-one (21) years old.
- I have not renounced my U.S. citizenship.
Prohibited Shipping Addresses
I will not request that Tombstone Tactical ship prohibited packages outside the lower forty-eight states of the United States or to Massachusetts, Chicago, New York City, or any other area that is prohibited by federal, state, or local law. Tombstone Tactical does ship to Illinois, New Jersey, and Connecticut when proper documentation is provided.
ALL FIREARMS MUST BE SHIPPED TO A VALID FEDERAL FIREARMS DEALER (FFL)
Tombstone Tactical complies with all federal, state, and local laws that restrict the sale and transfer of firearms, magazine feeding devices, ammo, and other prohibited products. The following is a list of restrictions that will include, in some cases policies set forth by Tombstone Tactical .
It is YOUR responsibility to know your local and state laws which may prohibit or restrict your ability to purchase certain products that Tombstone Tactical offers for sale.
Under the Gun Control Act (GCA), shotguns and rifles, and ammunition for shotguns or rifles may be sold only to individuals 18 years of age or older. All firearms other than shotguns and rifles, and all ammunition other than ammunition for shotguns or rifles may be sold only to individuals 21 years of age or older.
Not applicable for California (unless Law Enforcement) or Massachusetts.
No ammunition or primer shipments.

Indemnification and Agreement to Defend
I fully agree that if any of my representations when making purchases under the Terms of Sale are incorrect or if I fail to comply with these Terms of Sale, then I will indemnify, defend, save harmless, and release .com and its owners, agents, officers, and employees against any civil liability or criminal prosecution resulting from my purchase from Tombstone Tactical .
I fully agree that by placing my order, I release Tombstone Tactical from any and all liability arising from or related to the products I purchased from Tombstone Tactical , including (but not limited to) my or anyone else use of the product, my or anyone else’s storage of the product, and my or anyone else’s handling or transportation of the product, and I agree to indemnify, defend, save harmless, and release Tombstone Tactical and its owners, agents, officers, and employees against any civil liability or criminal prosecution resulting from the products I purchased from Tombstone Tactical .
Class Action Waiver
You expressly agree that any dispute resolution proceedings, including but not limited to, litigation, arbitration, and mediation, will be conducted only on an individual basis and not in a class, consolidated, or representative action. By making this express agreement, you acknowledge and affirm that this is a knowing, voluntary, and permanent waiver of any right to bring federal, state, or local claims as any part of, or on behalf of, any class or any other individuals, before a court or other tribunal.
Shipping is a flat rate charge through the most appropriate shipping source (USPS, UPS, FED-EX). All shipments can be expected within 15 days unless the item is out of stock or back ordered.
Tombstone Tactical and other marks indicated on our site are trademarks owned exclusively by Tombstone Tactical . The use of these trademarks and trade dress is prohibited if used in connection with the sale of any product that is not Tombstone Tactical , in any manner that seeks to disparages or discredit Tombstone Tactical or in any manner that may cause confusion among our customers.

CHANGES IN POLICY
Tombstone Tactical reserves the right to modify, alter, delete and update these policies at any time we see fit. Such alterations do not nullify our rights if infringements or breaches occurred under a previous version of these conditions.
REFUNDS AND EXCHANGES
We do not accept returns or exchanges unless the item you purchased is defective. If you receive a defective item, please contact us via email at firstname.lastname@example.org with details of the product and the defect. Further instructions will be provided if item is to be returned and/or exchanged.
Upon receipt of the returned product, we will fully examine it and notify you via e-mail, within a reasonable period of time, whether you are entitled to a refund or a replacement as a result of the defect. If you are entitled to a replacement or refund, we will replace the product or refund the purchase price, using the original method of payment.
Refunds do not include any shipping and handling charges shown on the packaging slip or invoice. Shipping charges for all returns must be prepaid and insured by you. You are responsible for any loss or damage to hardware during shipment. We do not guarantee that we will receive your returned item. Shipping and handling charges are not refundable. Any amounts refunded will not include the cost of shipping.

SIGNING UP AND OPTING-IN TO THE SERVICE
Enrollment in the Service requires you to provide your mobile phone number and to agree to these terms and conditions. You may not enroll if you are under 21 years old. Before the Service starts, you will need to agree to these Terms. Tombstone Tactical reserves the right to stop offering the Service at any time with or without notice. By opting into the Service, you:
- Authorize Tombstone Tactical to use auto dialer or non-auto dialed technology to send recurring text messages to the mobile phone number associated with your opt- in (i.e., the number listed on the opt-in form or, if none, the number from which you send the opt-in, or, if none, the number on file for the account associated with your opt-in).
- Acknowledge that you do not have to agree to receive messages as a condition of purchase.

CHARGES AND CARRIERS
Message and data rates may apply. Please consult your service agreement with your wireless carrier or contact your wireless carrier to determine your phone's pricing plan and the charges for sending and receiving text messages. You acknowledge that you are responsible for any message, data or other charges incurred (usage, subscription, etc.) as a result of using the Service.
Supported carriers are AT & T, T-Mobile, Verizon Wireless, Sprint, Boost, Virgin Mobile, U.S. Cellular, Cricket, Alltel, Cincinnati Bell, Cellcom, C-Spire, nTelos, MetroPCS, and other smaller regional carriers. The Service may not be available on all wireless carriers. Tombstone Tactical may add or remove any wireless carrier from the Service at any time without notice. Tombstone Tactical and mobile carriers are not responsible for any undue delays, failure of delivery, or errors in messages.
ARBITRATION AND CLASS ACTION WAIVER
Please read this carefully. It affects your rights. Any dispute or claim relating in any way to your use of Tombstone Tactical will be resolved by binding arbitration, rather than court.
This agreement to arbitrate is intended to be broadly interpreted, and expressly includes claims brought under the Telephone Consumer Protection Act, 47 U.S.C. § 227 et seq., or any other statute, regulation, or legal or equitable theory. You and Tombstone Tactical hereby agree that the Federal Arbitration Act, 9 U.S.C. 1, et seq. (“FAA”) applies to this agreement to arbitrate, and governs all questions of whether a dispute is subject to arbitration. Unless you and we agree otherwise in writing, arbitration shall be administered by the American Arbitration Association's Consumer Arbitration Rules in effect at the time of filing of the arbitration (the “AAA's Rules”). However, just as a court would, the arbitrator or arbitrators must honor the terms and limitations in this Agreement, and can award damages and relief (including any attorneys' fees) authorized by law and/or the AAA's Rules. The arbitration decision and award is final and binding, with some exceptions under the FAA, and judgment on the award may be entered in any court of competent jurisdiction.YOU AGREE THAT, BY ENTERING INTO THIS AGREEMENT, YOU AND TOMBSTONE TACTICAL ARE EACH WAIVING THE RIGHT TO A TRIAL BY JURY AND THE RIGHT TO PARTICIPATE IN ANY CLASS, REPRESENTATIVE, OR COLLECTIVE PROCEEDING.
THIS AGREEMENT DOES NOT ALLOW FOR CLASS ARBITRATIONS EVEN IF THE PROCEDURES OR RULES OF THE AAA WOULD. RATHER, YOU AND WE ARE ONLY ENTITLED TO PURSUE ARBITRATION ON AN INDIVIDUAL, BILATERAL BASIS. FURTHER, AND UNLESS YOU AND TOMBSTONE TACTICAL AGREE OTHERWISE IN WRITING, THE ARBITRATOR(S) MAY NOT CONSOLIDATE MORE THAN ONE INDIVIDUAL PARTY'S CLAIMS WITH ANY OTHER PARTY'S CLAIMS, AND MAY NOT OTHERWISE PRESIDE OVER ANY FORM OF A REPRESENTATIVE OR COLLECTIVE PROCEEDING.
You and Tombstone Tactical are each responsible for our respective costs relating to counsel, experts, and witnesses, as well as any other costs relating to the arbitration. Tombstone Tactical, however, will pay for the arbitration administrative or filing fees, including the arbitrator and/or other AAA case management fees, for any claim seeking $75,000 or less, unless the claim is determined by the arbitrator to be frivolous. Otherwise, the AAA's Rules regarding costs and payment apply. This agreement to arbitrate does not preclude you from bringing issues to the attention of federal, state, or local agencies. Such agencies can, if the law allows, seek relief against us on your behalf.
If any term of this Section (Arbitration and Class Action Waiver) is to any extent illegal, otherwise invalid, or incapable of being enforced, such term shall be excluded to the extent of such invalidity or unenforceability; all other terms hereof shall remain in full force and effect; and, to the extent permitted and possible, the invalid or unenforceable term shall be deemed replaced by a term that is valid and enforceable and that comes closest to expressing the intention of such invalid or unenforceable term. If application of this Severability provision should materially and adversely affect the economic substance of the transactions contemplated hereby, the Party adversely impacted shall be entitled to compensation for such adverse impact, provided the reason for the invalidity or unenforceability of a term is not due to serious misconduct by the Party seeking such compensation.
